Lawsuit for emotional distress?

I asked a question last night about the liklihood of a succesful lawsuit in the case of my friend- a man who had been told by his ex that she had terminated a pregnancy that she knew he had been trying for and wanted very much.

As a result of this, he has experienced intense anguish, insomnia (sometimes for full-nights, days in a row) depression and nightmares.

However, we now think that it may all have been a lie on behalf of the ex-girlfriend.

Is it possible for him to sue her for causing this emotional distress? He hasn’t been able to work for a few weeks now because of it, and his leave-time is running out.

Intentional infliction of mental distress…a difficult tort to succeed in, but not impossible. In Canada, at least, the test is this:

“(i) a wrongful act, omission, or statement by the defendant; (ii) intended to produce harm; (iii) that causes resultant mental harm of a serious nature.”
